Proponents of physical intentionality argue that the classic hallmarks of intentionality highlighted by Brentano are also found in purely physical powers. Critics worry that this idea is metaphysically obscure at best, and at worst leads to panpsychism or animism. I examine the debate in detail, finding both confusion and illumination in the physical intentionalist thesis. Analysing a number of the canonical features of intentionality, I show that they all point to one overarching phenomenon of which both the mental and the (...) physical are kinds, namely finality. This is the finality of ‘final causes’, the long-discarded idea of universal action for an end to which recent proponents of physical intentionality are in fact pointing whether or not they realise it. I explain finality in terms of the concept of specific indifference, arguing that in the case of the mental, specific indifference is realised by the process of abstraction, which has no correlate in the case of physical powers. This analysis, I conclude, reveals both the strength and weakness of rational creatures such as us, as well as demystifying the way in which powers work. (shrink)

What is the cultural value of illegal works that violate the copyrights of popular fiction? Why do they persist despite clear and stringent intellectual property laws? Drawing on the disciplines of new media, law, and literary studies, Illegal Literature suggests that extralegal works such as fan fiction are critical to a system that spurs the evolution of culture. Reconsidering voices relegated to the cultural periphery, David S. Roh shows how infrastructure--in the form of legal policy and network distribution--slows or (...) accelerates the rate of change. He analyzes the relationship between intellectual property rights and American literature in two recent copyright disputes. And, in comparing American fan fiction and Japanese dojinshi, he illustrates how infrastructure and legal climates detract from or encourage fledgling creativity. Illegal Literature fills a crucial gap between the scholarly and the popular by closely examining several modes of marginalized cultural production. Roh makes the case for protecting an environment conducive to literary heresy, the articulation of an accretive rather than solitary authorial genius, and the idea that letting go rather than holding on is important to a generative creative process. In a media ecology inundated by unauthorized materials, Illegal Literature argues that the proliferation of unsanctioned texts may actually benefit literary and cultural development. (shrink)

This paper describes differences in two perspectives on the idea of virtue as a theoretical foundation for positive organizational ethics (POE). The virtue ethics perspective is grounded in the philosophical tradition, has classical roots, and focuses attention on virtue as a property of character. The positive social science perspective is a recent movement (e.g., positive psychology and positive organizational scholarship) that has implications for POE. The positive social science movement operationalizes virtue through an empirical lens that emphasizes virtuous behaviors. From (...) a virtue ethics perspective, a behaviorally based account of virtue is a weak theory of virtue. Observations are suggested for integrating the two perspectives. First, virtue should always be understood as an excellence and is often an optimal point between extreme dysfunctions on continuum of potential states. Second, an empirical exploration of virtue needs to account for character and context. Finally, the properties of organization-level virtue need to be further specified and explored. Implications and directions for future research are discussed. (shrink)

Political advertising has long been a target for criticism regarding unethical behaviour. This study looks at the attitudes of Australian advertising agency executives and politicians towards ethical issues relating to political advertising. A sample of 101 advertising agency executives and 46 federal politicians were compared and some attitudinal differences were found, which could be areas of tension in the agency-client relationship.

I contend that though Pippin argues persuasively that the most trenchant critics of modernity ? Nietzsche and Heidegger ? failed to break free of modernity, it remains unclear whether the unending character of modernity is thereby defended as an unfinished project, or rather is a fate to which we are condemned. The thesis of my paper is that the ambiguity is traceable to Pippin's Hegelian narrative of legitimation. On his view, the demands of modern self?consciousness inaugurated by Kant and radicalized (...) by Hegel prohibit every appeal to a given, even where the given is construed as contingent historical shifts, or perspectives, or Ereignisse. But this rejection of appeals to something outside the narrative of legitimation implies that even the significance of the narrative can only be an effect of the narrative itself. But if this is true, there is on Pippin's own terms no way of establishing the significance of a narrative about modernity and hence no reason for finding it compelling. Thus the very radicalization of the Kantian critique of dogmatism that Pippin claims is the hallmark of modernity renders unavailable the legitimation of modernity. (shrink)

Although biologists and philosophers of science generally agree that genes cannot determine the forms of biological and psychological traits, students, journalists, politicians, and other members of the general public nonetheless continue to embrace genetic determinism. This article identifies some of the concerns typically raised by individuals when they first encounter the systems perspective that biologists and philosophers of science now favor over genetic determinism, and uses arguments informed by that perspective to address those concerns. No definitive statements can yet be (...) made about why genetic determinism has proven so resilient in the face of empirical evidence pointing up its deficiencies, but conveying the essential interdependence of 'nature' and 'nurture' to the general public will likely require deployment of the arguments that systems theorists ordinarily use to reject genetic determinism. In addition, the elaboration of new metaphors that focus attention on the dynamic nature of trait construction will likely prove valuable, because re-conceptualizing notions like 'genes' and 'nature' will probably be one of the most effective ways to help students and the general public abandon the genetic determinism that biologists now recognize as indefensible. Although Mealey's account provides several interesting hypotheses, her integration across disparate samples renders the value of her explanation for psychopathy ambiguous. Recent evidence on Psychopathy Checklist-identified samples (Hare, 1991) suggests primary emotional and cognitive deficits inconsistent with her model. Whereas high-anxious psychopaths display interpersonal deficits consistent with Mealey's hypotheses, low-anxious psychopaths' deficits appear more sensitive to situational parameters than predicted.

I argue that (a) the phenomenon characteristic of pragmatic presupposition, is distinct from (b) the phenomenon characteristic of semantic presupposition, and that there are sentences exhibiting (a) alone. I apply this to Stalnaker's defense of van Fraassen's theory of semantic presupposition against Karttunen. I show that, since Stalmaker fails to distinguish (a) from (b), this defense amounts to an unsuccessful attempt to explain pragmatically the supposed instances of (b) in Karttunen's counter-examples. I observe that, given the distinction between (a) and (...) (b), we can salvage from Stalnaker the strategy of discounting certain of Karttunen's counter-examples which exhibit not (b) but merely (a). (shrink)

Human rights discourse has been likened to a global lingua franca, and in more ways than one, the analogy seems apt. Human rights discourse is a language that is used by all yet belongs uniquely to no particular place. It crosses not only the borders between nation-states, but also the divide between national law and international law: it appears in national constitutions and international treaties alike. But is it possible to conceive of human rights as a global language or lingua (...) franca not just in a figurative or metaphorical sense, but in a literal or linguistic sense as a legal dialect defined by distinctive patterns of word choice and usage? Does there exist a global language of human rights that transcends not only national borders, but also the divide between domestic and international law? Empirical analysis suggests that the answer is yes, but this global language comes in at least two variants or dialects. New techniques for performing automated content analysis enable us to analyze the bulk of all national constitutions over the last two centuries, together with the world’s leading regional and international human rights instruments, for patterns of linguistic similarity and to evaluate how much language, if any, they share in common. Specifically, we employ a technique known as topic modeling that disassembles texts into recurring verbal patterns. The results highlight the existence of two species or dialects of rights talk—the universalist dialect and the positive-rights dialect—both of which are global in reach and rising in popularity. The universalist dialect is generic in content and draws heavily on the type of language found in international and regional human rights instruments. It appears in particularly large doses in the constitutions of transitional states, developing states, and states that have been heavily exposed to the influence of the international community. The positive-rights dialect, by contrast, is characterized by its substantive emphasis on positive rights of a social or economic variety, and by its prevalence in lengthier constitutions and constitutions from outside the common law world, especially those of the Spanish-speaking world. Both dialects of rights talk are truly transnational, in the sense that they appear simultaneously in national, regional, and international legal instruments and transcend the distinction between domestic and international law. Their existence attests to the blurring of the boundary between constitutional law and international law. (shrink)

This article presents theory and practical experiences related to classroom pedagogy focusing on spirituality and wholeness - the spiritually whole-system classroom. In it, spiritual principles help create a learning community founded on the experience of wholeness. The spiritually whole-system classroom allows participants the opportunity of "being connected with one's complete self, others, and the entire universe" in order to serve a meaningful, broader purpose. This type of transformation engages heads, hearts, spirits, and hands in the pursuit of a more enlightening (...) experience of human organizing. Caretaker-infant attachment is a complex but well-recognized adaptation in humans. An early instance of (or precursor to) attachment behavior is the dyadic interaction between adults and infants of 6 to 24 weeks, commonly called "babytalk." Detailed analysis of 1 minute of spontaneous babytalk with an 8-week infant shows that the poetic texture of the mother’s speech—specifically its use of metrics, phonetics, and foregrounding—helps to shape and direct the baby’s attention, as it also coordinates the partners’ emotional communication. We hypothesize that (...) the ability to respond to poetic features of language is present as early as the first few weeks of life and that this ability attunes cognitive and affective capacities in ways that provide a foundation for the skills at work in later aesthetic production and response. By linking developmental social processes with formal cognitive aspects of art, we challenge predominant views in evolutionary psychology that literary art is a superfluous byproduct of adaptive evolutionary mechanisms or primarily an ornament created by sexual selection. In recent years, the discipline of archaeology has witnessed its scientific base challenged by new interpretive approaches, new kinds of data and proposals for new levels of social relevance. The Reader in Archaeological Theory comprises a summary perspective on these different trends, problems and currents in recent archaeological method and theory, how they are related, and how they differ. Remarkable in its emphasis on North American research, many of the papers in this volume focus on ancient Mesoameria and the native (...) peoples of our continent. The breadth of scholarship covered in the Reader demonstrates how a variety of disciplines--from cognitive neuroscience to poststructural semiotics--have influenced some newer approaches to archaeological theory. We propose a formal framework for interpretable machine learning. Combining elements from statistical learning, causal interventionism, and decision theory, we design an idealised explanation game in which players collaborate to find the best explanation for a given algorithmic prediction. Through an iterative procedure of questions and answers, the players establish a three-dimensional Pareto frontier that describes the optimal trade-offs between explanatory accuracy, simplicity, and relevance. Multiple rounds are played at different levels of abstraction, allowing the players to explore overlapping causal (...) patterns of variable granularity and scope. We characterise the conditions under which such a game is almost surely guaranteed to converge on a optimal explanation surface in polynomial time, and highlight obstacles that will tend to prevent the players from advancing beyond certain explanatory thresholds. The game serves a descriptive and a normative function, establishing a conceptual space in which to analyse and compare existing proposals, as well as design new and improved solutions. (shrink)

In 1982, without waiting for the findings of the National Hospice Study, Congress passed legislation enabling certified hospices to receive Medicare reimbursement. What emerged is a reimbursement program that differs substantially from the movement that spawned it. Hospices now face many dilemmas, among them shifting the burden of care to the family, determining who controls the course of patient care, and breaking even financially.

This contribution to part 4 of the Common Knowledge symposium “Fuzzy Studies: On the Consequence of Blur” shows how the reputedly radical position that history is not about eternal truths but about the creative construction of a convincing narrative of past events is not an argument of recent vintage. In the days when postmodernism was a technical term used mainly by scholars of art and architecture—and indeed, decades before then—professional historians were grappling with the incapacity of facts to write themselves (...) into a universally satisfying, single version of history. Successive presidents of the American Historical Association such as Andrew Dickson White, Carl Becker, Charles Beard, and William McNeill admitted that writing history is a desperate attempt at pattern recognition in a fuzzy discipline. Pattern recognition is a tool, valuable as a stage in historical thinking, but destined ultimately to come undone. What remains, then, is fuzzy thinking. It can be a good thing, the article concludes, to let our thinking about history remain a blur or, at least, to bear in mind that any patterns we recognize in the past are liable to dissolve under a different light. As machine learning has gradually entered into ever more sectors of public and private life, there has been a growing demand for algorithmic explainability. How can we make the predictions of complex statistical models more intelligible to end users? A subdiscipline of computer science known as interpretable machine learning (IML) has emerged to address this urgent question. Numerous influential methods have been proposed, from local linear approximations to rule lists and counterfactuals. In this article, I highlight three conceptual challenges that (...) are largely overlooked by authors in this area. I argue that the vast majority of IML algorithms are plagued by (1) ambiguity with respect to their true target; (2) a disregard for error rates and severe testing; and (3) an emphasis on product over process. Each point is developed at length, drawing on relevant debates in epistemology and philosophy of science. Examples and counterexamples from IML are considered, demonstrating how failure to acknowledge these problems can result in counterintuitive and potentially misleading explanations. Without greater care for the conceptual foundations of IML, future work in this area is doomed to repeat the same mistakes. (shrink)

The Dead Donor Rule holds that removing organs from a living human being without their consent is wrongful killing. The rule still prevails in most countries, and I assume it without argument in order to pose the question: is it possible to have a metaphysically correct, clinically relevant analysis of human death that makes organ donation possible? I argue that the two dominant criteria of death, brain death and circulatory death, are both empirically and metaphysically inadequate as definitions of human (...) death, and therefore of no epistemic value in themselves. I first set out a neo-Aristotelian theory of death as separation of soul (understood as organising principle) and body, which is then fleshed out as loss of organismic integrity. The brain and circulatory criteria are shown to have severe weaknesses as physiological manifestations of loss of integrity. Given the mismatch between what death is metaphysically speaking, and the dominant criteria accepted by clinicians and philosophers, it turns out that only actual bodily decomposition is a sure sign of death. In this I differ from Alan Shewmon, whose important work I discuss in detail. (shrink)

Inborn errors of vitamin B12 (cobalamin) metabolism are associated with homocystinuria and methylmalonic aciduria, either alone or in combination. A number of these disorders have provided the first evidence for the existence of important steps in the transport or metabolism of cobalamin in eukaryotic cells. Eight complementation classes have been defined on the basis of somatic cell hybridization studies. Although the majority of patients present in infancy or early childhood, some are not diagnosed until adolescence or later. For some of (...) these disorders, prenatal diagnosis and therapy with cobalamin during pregnancy has been attempted. Although only males have been described with cblE disease, all of these disorders are presumed to be autosomal recessive in inheritance. The clinical and laboratory aspects of the different complementation classes (cblA–cblG) are reviewed here. (shrink)

From Kierkegaard’s famous polemic against Hegel’s system, and Marx’s rejection of the “mysticism” of reason, to Heidegger’s claim that Hegel completes the tradition of western metaphysics, and contemporary critics’ identification of Hegel as the authoritative spokesman — the “Master” — for the principles of unity and identity, a standard view has governed interpretations and evaluations of Hegel’s philosophy. Though familiarity with the positions just cited reveals considerable disparity, one does not need an especially discerning eye to recognize the common features (...) of the figures drawn. Hegel is, in all of them, the philosopher of the Absolute, the proponent of metaphysics without equal in the modern world. (shrink)

BackgroundAs suggested by Shook and Giordano, understanding and therefore addressing the urgent international governance issues around globalizing bio-medical/technology research and applications is limited by the perception of the underlying science.MethodsA philosophical methodology is used, based on novel and classical philosophical reflection upon existent literature, clinical wisdoms and narrative theory to discover a meta-science and telos of humankind for the development of a relevant and defendable global biomedical bioethics.ResultsIn this article, through pondering an integrative systems approach, I propose a biomedical model (...) that may provide Western biomedicine with leadership and interesting insight into the unity beyond the artificial boundaries of its traditional divisions and the limit between physiological and pathological situations. A unified biomedicine, as scientific foundation, might then provide the basis for dissolution of similar reflected boundaries within bioethics. A principled and communitarian cosmopolitan bioethics may then be synonymous with a recently proposed principled and communitarian cosmopolitan neuroethics based on a novel objective meta-ethics. In an attempt to help facilitate equal and inclusive participation in inter-, multi-, and transdisciplinary intercultural discourse regarding the aforementioned international governance issues, I offer: a meta-science derived through considering the general behaviour of activity, plasticity and balance in biology and; a novel thought framework to encourage and enhance the ability for self-evaluation, self-criticism, and self-revision aimed at broadening perspective, as well as acknowledging and responding to the strengths and limitations of extant knowledge.ConclusionsThrough classical philosophical reflection, I evolve a theory of medicine to discover a telos of humankind which in turn provides an ‘internal’ moral grounding for a proposed global biomedical bioethics.
